International Litigation and Mediation for International Businesses in Asia – Singapore's Game-Changing Initiatives

The Singapore Institute of Arbitrators (“SIArb”) hosted a conference entitled “The International Litigation and Mediation for International Businesses in Asia – Singapore’s Game-Changing Initiatives on 29 January 2015.

George Lim SC, Deputy Chairman of the Singapore International Mediation Centre (“SIMC) spoke to the audience, mainly composed of arbitrators, about the demand for international mediation as well as SIMC’s services, including the Arb-Med-Arb service jointly offered with the Singapore International Arbitration Centre. George emphasised that lawyers play a crucial role in advising their clients on the mode(s) of resolution of conflict they should use, and in the mediation process itself the lawyer’s assistance is required from beginning to end – from ensuring that the parties are suitably prepared for mediation to the drafting of the settlement agreement.

Chan Leng Sun SC, Principal at Baker & McKenzie. Wong Leow LLP and President of SIArb, then introduced the new Singapore International Commercial Court (“SICC”), describing its hybrid nature with its panel of international Judges from both Common Law and Civil Jurisdictions as well as some of its unique procedural rules.

Both speakers stressed that the legal community as a whole will benefit from the creation of SIMC and SICC: given the regional economic integration of ASEAN in 2015 and the steady growth of investments in Asia, the number of cross-border disputes is likely to increase. The choice of a wider range of dispute resolution services will encourage international users to choose Singapore as a venue to resolve their disputes. With the SIMC and SICC, Singapore, which is already renowed as one of the world’s most preferred seats for arbitration, will enhance its leading role a a neutral and reliable place to resolve conflicts.
